OutCaller provides an AI-powered calling assistant service with integrated Google Drive and Google Sheets functionality. We reserve the right to modify or discontinue, temporarily or permanently, the service with or without notice. Users must obtain prior consent from call recipients before using our outbound calls service.

Google Services Integration

Our service integrates with Google Drive and Google Sheets to provide enhanced data management capabilities. This integration includes:

• Google Picker for file selection from your Google Drive
• Real-time synchronization with your Google Sheets
• Webhook-based notifications for spreadsheet updates
• Bidirectional data sync between your spreadsheets and our platform

3. User Responsibilities

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

Google Integration Responsibilities

When using Google services integration, you agree to:

• Only connect Google accounts that you own or have proper authorization to use
• Ensure you have the right to share and synchronize data contained in your Google Sheets
• Comply with Google's Terms of Service and acceptable use policies
• Maintain the security of your Google account credentials
• Regularly review and manage connected applications in your Google account settings

4. Privacy Policy

Your use of OutCaller is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the site and informs users of our data collection practices, including how we handle data accessed through Google services.

5. Intellectual Property

The content, organization, graphics, design, compilation, magnetic translation, digital conversion, and other matters related to the Service are protected under applicable copyrights, trademarks, and other proprietary rights.

6. Third-Party Services

Google Services

Our integration with Google Drive and Google Sheets is subject to Google's Terms of Service. By using these integrations, you acknowledge that:

• Google's terms and policies apply to your use of Google services through our platform
• We are not responsible for Google's service availability or changes to their APIs
• Data synchronization depends on Google's service reliability and your account status
• Google may change their terms or discontinue services that could affect our integrations

Analytics Services

We use PostHog for analytics to improve our service. Analytics tracking is only enabled with your explicit consent through our cookie banner. You may opt out at any time, and no tracking will occur if consent is not provided.

7. Data Ownership and Usage Rights

Your Data

You retain ownership of all data you upload, create, or synchronize through our service. By using Google services integration:

• You grant us permission to access and process data from connected Google services as necessary to provide our services
• You confirm you have the right to authorize us to access and process this data
• You understand that data synchronization may create copies of your data in our systems

8. Service Limitations and Availability

Our service is subject to:

• Google API rate limits and quotas
• Third-party service availability and maintenance schedules
• Network connectivity and internet service reliability
• Your Google account status and permissions
• 99.9% uptime target (but not guaranteed)

9. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. OutCaller expressly disclaims all warranties of any kind, whether express or implied. This includes but is not limited to the reliability, accuracy, or completeness of data synchronized through Google services integrations.

10. Limitation of Liability

OutCaller shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, including but not limited to:

• Data loss or corruption during synchronization processes
• Service interruptions affecting Google services integration
• Changes to third-party APIs or service discontinuation

11. Account Termination

We reserve the right to terminate your account if you violate these terms. Upon termination:

• Your access to Google services integrations will be disconnected
• We will cease accessing your Google services on your behalf
• You may need to manually revoke our access through your Google account settings

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising from these terms will be resolved through binding arbitration in accordance with Indian arbitration laws, or through the appropriate courts in India.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. It is your responsibility to check these Terms periodically for changes. Changes to terms affecting Google services integration will be communicated through your account dashboard when possible.

15. Compliance and Regulatory Requirements

Data Protection

When using Google services integration, both parties must comply with applicable data protection laws, including:

• General Data Protection Regulation (GDPR) where applicable
• California Consumer Privacy Act (CCPA) where applicable
• Information Technology Act, 2000 (India)
• Other relevant local privacy and data protection regulations

16. Service Level Agreement

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service availability. Planned maintenance will be communicated in advance when possible.
